Host Agreement

This Host Agreement (the "Agreement") is between you ("Host") and ParkLocalDC. It supplements the Terms of Serviceand the Parking Rules & Safety Policy, which are incorporated by reference. By publishing a listing, you confirm and agree to the following.
1. Authority to list
- You own the listed parking space or hold a lease, license, deeded right, or other documented authority that permits you to license the space to third parties for short-term parking.
- You have reviewed and complied with any HOA, condominium, cooperative, lease, mortgage, lender, insurance, and local-law restrictions that may apply.
- The space is private, off-street parking. You will not list public street parking, RPP zones, metered spaces, fire lanes, accessible spaces you are not authorized to license, or any space you do not control.
2. Listing accuracy
- Your listing (photos, dimensions, height/weight limits, surface type, lighting, security features, access instructions, pricing, availability) will be accurate and kept up to date.
- You will not misrepresent the location, ownership, or characteristics of the space.
- You will provide clear, current access instructions and respond to Renter messages in a timely manner.
3. Availability and bookings
- You will honor confirmed bookings and keep the space available, clear, and accessible for the booked window.
- You will not cancel confirmed bookings except for legitimate reasons (e.g., emergency, safety, or inaccessibility). Repeated last-minute Host cancellations may result in suspension.
- If the space becomes unavailable, you will notify ParkLocalDC immediately and assist with rebooking or refunds.
4. Fees, payouts, and taxes
- ParkLocalDC charges a transparent platform fee disclosed at checkout. Payouts to Hosts are processed manually by ParkLocalDC via Stripe after the Host submits a payout request through the platform dashboard. Payouts are subject to confirmation of completed bookings.
- You are solely responsible for reporting and paying any income, sales, use, occupancy, or other taxes arising from your rental activity.
- You authorize ParkLocalDC to offset Host payouts for refunds, chargebacks, overpayments, or amounts owed under this Agreement.
5. Safety, condition, and insurance
- You are responsible for the condition and safety of the listed space and any common areas reasonably necessary to access it.
- You will maintain any insurance required by your lease, HOA, lender, or applicable law. ParkLocalDC does not provide insurance to Hosts.
- You will not allow conditions that pose a foreseeable hazard to Renters or their vehicles (e.g., low-hanging obstructions, sinkholes, ice without warning, locked-in vehicles).
6. Disputes and overstays
- You will use the in-platform tools (messaging, overstay reports, dispute submissions) before pursuing off-platform remedies.
- Subject to DC law, you may arrange towing of unauthorized or overstaying vehicles at the vehicle owner's expense; you will not retaliate, damage, or restrain vehicles unlawfully.
- ParkLocalDC may, but is not required to, mediate disputes and may issue refunds or withhold payouts based on the available evidence.
7. Indemnification
You agree to indemnify, defend, and hold harmless ParkLocalDC and its affiliates from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of (a) your listing or the condition of your space, (b) your breach of this Agreement or applicable law, (c) any injury, damage, or loss occurring at the space, or (d) any dispute between you and a Renter, except to the extent caused by ParkLocalDC's gross negligence or willful misconduct.
8. Term and termination
This Agreement remains in effect while you maintain any active listing. ParkLocalDC may suspend or remove listings, withhold payouts, or terminate this Agreement at any time for violations of these terms, the Parking Rules, the Terms of Service, or applicable law.
