Terms of Service

These Terms of Service ("Terms") form a binding legal agreement between you and ParkLocalDC ("ParkLocalDC", "we", "us", or "our") governing your access to and use of the ParkLocalDC website and related services (collectively, the "Service"). By creating an account, listing a parking space, booking a parking space, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

ParkLocalDC operates an online marketplace that connects vehicle owners ("Renters") with owners or authorized lessees of private, off-street parking spaces ("Hosts") in Washington, DC. ParkLocalDC is a technology platform only. We are not a party to any rental, license, or other agreement between Hosts and Renters, do not own, operate, manage, or control any parking space, and do not act as an agent, broker, insurer, or guarantor for either party. Hosts list spaces and set their own prices, availability, and access rules. Renters contract directly with Hosts when they book a space.

2. Eligibility and accounts

You must be at least 18 years old, hold a valid driver's license (if booking as a Renter), and have the legal capacity to enter into a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to update it as needed. We may suspend or terminate accounts that contain false, misleading, or fraudulent information.

3. Listings and Host obligations

By creating a listing, the Host represents and warrants that:

  • The space is private, off-street parking that the Host owns or has the legal right to license to third parties.
  • Listing the space does not violate any lease, mortgage, HOA, condominium, cooperative, zoning, or other agreement or law.
  • The space description, photos, dimensions, access instructions, and availability are accurate and kept up to date.
  • The Host carries any insurance required by their lease, HOA, lender, or applicable law.

Hosts are solely responsible for the condition, safety, and legality of their listed spaces and for compliance with all applicable laws, including the District of Columbia residential parking permit ("RPP") rules, fire-lane and accessibility requirements, and any applicable tax obligations on rental income.

Hosts are independent operators, not employees, agents, or partners of ParkLocalDC. Hosts retain full control over their parking spaces, including the right to set their own prices, availability, and house rules. ParkLocalDC is a technology platform and marketplace facilitator that connects hosts and renters — it does not own, operate, control, or manage any parking spaces listed on the platform. The relationship between ParkLocalDC and hosts is that of an independent platform and an independent service provider. Hosts are solely responsible for determining and fulfilling any tax obligations arising from their rental income.

3b. Vehicle damage and insurance

ParkLocalDC is a technology platform only and does not provide insurance coverage for vehicles parked through the Service. Renters park at their own risk and are encouraged to confirm their personal auto insurance covers parking in private spaces. Hosts are not responsible for damage caused by third parties, weather, or events outside their reasonable control. Any damage disputes between Hosts and Renters are handled pursuant to Section 6 of these Terms.

4. Bookings and Renter obligations

By booking a space, the Renter agrees to:

  • Use the space only during the booked time window and only for parking a single private passenger vehicle that fits the listed dimensions.
  • Follow the Host's posted access instructions and the platform Parking Rules & Safety Policy.
  • Not block driveways, alleys, sidewalks, fire lanes, accessible spaces, or other vehicles at any time.
  • Not store hazardous materials in the vehicle and not leave the vehicle beyond the booking window.

5. Fees, payments, and taxes

Renters pay the booking price and any service fees disclosed at checkout. ParkLocalDC charges a transparent platform fee that is itemized prior to booking confirmation. All payments are processed by our third-party payment processor (Stripe, Inc.). By using the Service, you authorize ParkLocalDC and its processor to charge your selected payment method for amounts owed, including authorization holds, captures, refunds, and any chargeback-related fees. Hosts are responsible for any income, sales, use, or other taxes arising from their rental activity.

6. Cancellations, refunds, and disputes

Each listing displays a cancellation policy chosen by the Host. Refund eligibility follows that policy. If a booking cannot be honored (for example, the space is blocked, inaccessible, or materially different from the listing), the Renter may report the issue through the Service within 24 hours and is generally eligible for a full or partial refund at ParkLocalDC's reasonable discretion. ParkLocalDC may, but is not required to, mediate disputes between Hosts and Renters and may issue refunds, withhold Host payouts, or take other corrective action based on the available evidence.

7. Overstays, towing, and enforcement

Renters who remain in a space after their booking window without an approved extension may be charged additional fees at the listed hourly rate plus a reasonable overstay fee, and the Host may, subject to applicable DC law, arrange towing at the vehicle owner's expense. Repeated violations may result in account suspension or permanent ban from the Service.

8. Prohibited conduct

You agree not to:

  • List public street parking, RPP zones, metered spaces, fire lanes, accessible spaces you are not authorized to license, or any space you do not lawfully control.
  • Use the Service for any unlawful, fraudulent, abusive, or harassing purpose.
  • Circumvent ParkLocalDC by transacting off-platform after meeting another user through the Service.
  • Scrape, reverse-engineer, copy, or interfere with the Service or its users.
  • Upload content that infringes intellectual property, privacy, or other rights of any third party.

9. Content license

You retain ownership of content you submit (photos, descriptions, reviews) but grant ParkLocalDC a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, display, adapt, and distribute that content for the purpose of operating, promoting, and improving the Service.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PARKLOCALDC DOES NOT WARRANT THE CONDUCT OF ANY HOST OR RENTER, THE ACCURACY OF ANY LISTING, OR THE AVAILABILITY, LEGALITY, OR SAFETY OF ANY PARKING SPACE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARKLOCALDC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO PARKLOCALDC IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless ParkLocalDC and its affiliates from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your breach of these Terms, (c) your violation of any law or third-party right, or (d) any dispute between you and another user.

13. Governing law and dispute resolution

These Terms are governed by the laws of the District of Columbia, without regard to its conflict-of-laws rules. The exclusive venue for any dispute that is not subject to arbitration shall be the state or federal courts located in the District of Columbia, and you consent to personal jurisdiction in those courts. Any claim must be brought within one (1) year after it arises or be permanently barred.

13b. Informal resolution and arbitration

Before filing any claim, the parties agree to attempt to resolve the dispute informally by contacting support@parklocal.us. If not resolved within 30 days, any dispute arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules in Washington, DC. Each party retains the right to seek injunctive relief in court to prevent irreparable harm. CLASS ACTION WAIVER: Any arbitration or proceeding shall be limited to the dispute between us individually. You waive any right to a class action lawsuit or class-wide arbitration.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any conduct that we reasonably believe violates these Terms or harms the Service, other users, or third parties. Upon termination, sections 5–13 and 15 survive.

15. Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms with an updated "Last updated" date and, for material changes, provide additional notice. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
